I want to introduce a book that will be published soon in Brazil: Pachamama and the Human Being, (La Pachamama y el ser humano, Ediciones Colihue, 2012) by Eugenio Raúl Zaffaroni, well known in Brazil's judicial circles. Zaffaroni is a distinguished Argentinean magistrate, a member of the Supreme Court from 2003 to 2014; and professor emeritus at the University of Buenos Aires.

Pachamama and the Human Being is among the best eco-philosophical contributions written of late. It is in the lineage of the 2015 encyclical, Laudato Si, on the Caring for the Common Home, by Pope Francis, also Argentinean.  With admirable scientific and philosophical data, Zaffaroni addresses the question of integral ecology, especially social violence, and in particular, violence against animals. 

The most important aspect of his book is its critique of the dominant paradigm, that arose with the founding fathers of the XVI and XVII century modernity that abruptly introduced a profound division between the human being and nature. The natural contract, present from time immemorial in the Occidental and Oriental culures, suffered a fatal and lethal blow. 

The Earth stopped being The Magna Mater of ancient times, the Pachamama of the nations of the Andes... the Gaia of the contemporaries, something alive and a generator of life, and was transformed into an inert thing (the res extensa of Rene Descartes): a collection of resources at the disposal of the unlimited voracity of human beings. The formulation by Descartes is classic: the human being is the maître et possesseur of nature, namely, the human being is master and lord of nature. The human being can do with nature what the human being pleases.  And humans have done exactly that.   

Modern culture was built on the understanding that the human being is dominus, lord and owner of everything. Things do not have intrinsic value. Contrary to what later will be affirmed by the Earthcharter, and with powerful strength by Pope Francis' encyclical letter, things have value only because they can serve human beings. 

This is the project of power, understood as a capacity to dominate everything, based on who holds the most power. In this case, it was the Europeans, who carried out the program of subjugating nature, the invasion and conquest of the world, the colonization of whole nations, the genocide, ecocide and destruction of ancestral cultures.  And they did it using the brutal strength of their weapons: the Cross and the sword. And now they accomplish it with weapons capable of extinguishing the human species. 

Zaffaroni studies the emergence of this aspect of civilization, and does so with a great bibliographical wealth. Courageously and with great critical freedom, he faces the conceited coryphaeus of modern thinking like Friedrich Hegel, Herbert Spencer, Charles Darwin and Martin Heidegger. I will concentrate on his criticisms of the Hegel of the Geist, (spirit). With his philosophy-ideology Hegel became the main exponent of ethnocentrism. Spencer with his biologism enshrined the White race as superior and considered all other races inferior, which wound up legitimizing colonialism and all types of prejudice. 

Zaffaroni touches the question of the animal, understood as a subject of rights. He writes: "in our judgment, the juridical value of the crime of mistreatment of animals is none other than recognition of the right of the animal itself not to be object of human cruelty, for which it is necessary to recognize the character of the animal as a subject of rights". The author is harsh in demonstrating that "we have turned out to be the biological champions of intra-species destruction and the greatest inter-species predators". His proposal is clear: "Only by substituting the knowledge of the dominus for the frater we can regain human dignity" and experience brotherhood and sisterhood with all other beings. 

Latin America was the first to inaugurate an ecological constitutionalism, including the rights of nature and of Mother Earth in the Constitutions of Ecuador and Bolivia. Previously, and also for the first time, it was Mexico that introduced social rights in her Constitution of 1917. Zaffaroni eulogizes the creative potentialities inherent in the Andean vision of "good living and coexisting" (sumak kawsay) - the harmony of the human being with nature; and as also seen in Gaia - the Earth as a living, self-regulating super organism, always producing and reproducing life. Pachamama and Gaia are two paths that encounter each other "in a happy coincidence of the center and the periphery of planetary power".  Both are carriers of the hope for an Earth Common Home, where all beings are included. They will liberate us from the apocalyptic threats of the end of our civilization and of life. 

Zaffaroni brings us a brilliant and convincing perspective, a severe criticism on the one hand, but also one filled with hope on the other. He deserves to be read, studied, and that his vision of an holistic ecology that profoundly integrates all the elements of nature and of the universe be incorporated into our understanding.

El encuentro feliz de la Pachamama con Gaia

Quiero presentar un libro que en breve saldrá traducido en Brasil: La Pachamama y el ser humano(Ediciones Colihue 2012) de Eugenio Raúl Zaffaroni, bien conocido en Brasil en el ámbito jurídico. Es un reconocido magistrado argentino, ministro de la Corte Suprema desde 2003 a 2014 y profesor emérito de la Universidad de Buenos Aires.

El presente libro se inscribe entre las mejores contribuciones de orden ecológico y filosófico que se han escrito últimamente. Se sitúa en la línea de la encíclica del Papa Francisco, también argentino, Laudato Si, sobre el cuidado de la Casa Común (2015). Zaffaroni aborda la cuestión de la ecología integral, especialmente la violencia social y particularmente la violencia contra los animales, con una información admirable de orden científico y filosófico. 

Lo más importante del libro es la crítica del paradigma dominante, surgido con los padres fundadores de la modernidad de los siglos XVI y XVII que ex abrupto introdujeron una profunda cisura entre el ser humano y la naturaleza. El contrato natural, presente en las culturas de Occidente y Oriente desde tiempos inmemoriales, sufrió un corte fatal y letal. 

La Tierra dejó de ser la Magna Mater de los antiguos, la Pachamama de los andinos y la Gaia de los contemporáneos, algo vivo y generador de vida, para ser transformada en una cosa inerte (res extensa de Descartes), en un mostrador de recursos colocados a disposición de la voracidad ilimitada de los seres humanos. Es clásica la formulación de René Descartes: el ser humano es el maître et possesseur de la naturaleza, es decir, es el amo y señor de la naturaleza. Puede hacer de ella lo que bien le parezca. Y lo ha hecho. 

La cultura moderna se construyó sobre la comprensión del ser humano como dominus, como señor y dueño de todas las cosas. Estas no poseen valor intrínseco, en contra de lo que van a afirmar más tarde la Carta de la Tierra y con gran fuerza la encíclica papal. Su valor reside sólo en poder estar al servicio del ser humano. 

Es el proyecto del poder, entendido como capacidad de dominación sobre todo y sobre todos, partiendo de quien tiene más poder. En este caso, los europeos, que realizaron la aventura del sometimiento de la naturaleza, la conquista del mundo, la colonización de naciones enteras, el genocidio, el ecocidio y la destrucción de culturas ancestrales. Y lo hicieron usando la fuerza brutal de sus armas: la cruz y la espada. Hoy en día con armas capaces de extinguir la especie humana. 

Zaffaroni rastrea el surgimiento de este proyecto civilizatorio y lo hace con gran riqueza bibliográfica. Se enfrenta con valor y con gran libertad crítica a los presumidos corifeos del pensamiento moderno como Hegel, Spencer, Darwin y Heidegger. Me restrinjo a las críticas que hace al Hegel del Geist (espíritu). Con su filosofía-ideología se volvió el mayor exponente del etnocentrismo. Herbert Spencer con su biologismo estableció la raza blanca como superior y todas las demás consideradas como inferiores, lo que acabó por legitimar el colonialismo y todo tipo de prejuicios. 

Zaffaroni aborda la cuestión del animal visto como sujeto de derechos. Escribe: "a nuestro juicio, el bien jurídico en el delito de malos tratos a animales no es otro que el derecho del propio animal a no ser objeto de crueldad humana, para lo cual es menester reconocerle el carácter de sujeto de derechos". El autor es duro al constatar "que nos hemos convertido en los campeones biológicos de la destrucción intra-especie y en los depredadores máximos extra-especie". Su propuesta es clara: "Solamente sustituyendo el saber del dominus por el de frater podemos recuperar la dignidad humana" y sentirnos hermanados con los demás seres. 

América Latina fue la primera en inaugurar un constitucionalismo ecológico, incluyendo en las constituciones de Ecuador y Bolivia los derechos de la naturaleza y de la Madre Tierra. Anteriormente, y también por primera vez, fue México quien introdujo en su constitución de 1917 los derechos sociales. Zaffaroni hace la apología de las virtualidades creadoras de armonía del ser humano con la naturaleza que la visión andina del "buen vivir y convivir" (sumak kawsay) comporta; también de Gaia, la Tierra como un superorganismo vivo que se autorregula para siempre producir y reproducir vida. La Pachamama y Gaia son dos caminos que se encuentran "en una feliz coincidencia del centro y de la periferia del poder planetario". Ambos son portadores de esperanza de una Tierra Casa Común, en la cual todos los seres están incluidos. Ellos nos liberarán de las amenazas apocalípticas del fin de nuestra civilización y de la vida. 

Zaffaroni nos trae una brillante y convincente perspectiva, crítica severa por un lado, pero llena esperanza por otro. Merece la pena leerlo, estudiarlo e incorporar en nuestra comprensión su visión de una ecología holística y profundamente integradora de todos los elementos de la naturaleza y del universo.
