Experto en Derechos Humanos de la ONU: "EE.UU. comete crímenes de lesa humanidad contra Venezuela"

Dos días después de la tensa jornada vivida en la frontera colombo-venezolana, el pasado 23 de febrero, el autodenominado Grupo de Lima acordó impulsar la designación, por parte del Consejo de Derechos Humanos de las Naciones Unidas, de un experto independiente para evaluar lo que califican como una "crisis humanitaria" en Venezuela.
El cónclave, que agrupa a naciones alineadas al intento de EE.UU. de deponer el Gobierno del presidente Nicolás Maduro, calificó como un "crimen de lesa humanidad" que se impidiera el ingreso por la fuerza de un lote de "ayuda humanitaria" desde Colombia, que intentó entrar por órdenes del autoproclamado "presidente encargado", Juan Guaidó.
Sobre el tema, Alfred-Maurice de Zayas, experto en Derechos Humanos designado por Naciones Unidas para la promoción de un orden internacional democrático e igualitario (2012-2018), dispuso en su cuenta en Twitter la firma de un documento para que la Alta Comisionada de Derechos Humanos, Michelle Bachelet, visite Venezuela y constate la verdadera situación del país. La misma petición fue hecha en noviembre pasado por el presidente Nicolás Maduro.

El también ex secretario del Comité de Derechos de la ONU ofrece su perspectiva luego de haber visitado Venezuela para entrevistarse con autoridades oficiales, expertos y dirigentes de oposición e instituciones públicas y privadas del país caribeño.
Rusia Today (RT): ¿Hay una crisis humanitaria en Venezuela?
Alfred-Maurice de Zayas (A.Z.): Cuando estuve en Venezuela en noviembre- diciembre de 2017, ciertamente no había crisis humanitaria. Cualquier comparación con Gaza, Yemen, Siria, Libia, Sudán es absurda. Pero la situación ha empeorado desde entonces a causa de las sanciones.
RT: ¿Cree que las sanciones de EE.UU. están dirigidas a afectar al gobierno de Nicolás Maduro?
A.Z.: Las sanciones son un factor importante que contribuye a la crisis. La malnutrición y la falta de medicamentos pueden atribuirse directamente a las sanciones, y constituyen delitos geopolíticos en la categoría de crímenes de lesa humanidad.

RT: EE.UU. advierte que Venezuela necesita "ayuda humanitaria". ¿Está el país en el mismo escenario que Libia, Yemen, Malí, Somalia, Sudán y Myanmar?
A.Z.: Venezuela solo necesita poner fin al bloqueo financiero y las sanciones. Venezuela ha agradecido la asistencia internacional para resolver los problemas creados por las sanciones. EE.UU. no puede estrangular primero la economía venezolana y luego reclamar que el país necesita asistencia humanitaria. Esto es cínico, maquiavélico, de mala fe en extremo. No puedes ser el torturador y el salvador al mismo tiempo.
RT: Los detractores de Maduro, incluyendo EE.UU., dicen que Venezuela comete un "crimen de lesa humanidad" al no permitir que entre "ayuda humanitaria". ¿Qué piensa sobre eso?
A.Z.: El Gobierno de EE.UU., y otros países que imponen sanciones, son los que cometen crímenes de lesa humanidad. Venezuela, por supuesto, acepta cualquier asistencia ofrecida de buena fe, y ya ha recibido 933 toneladas de alimentos y medicamentos de China, India, Turquía. Hace unos días llegó un avión de carga de Rusia con toneladas de medicamentos y equipo médico. Venezuela acepta asistencia de la ONU y de otros organismos, pero no de su principal torturador.
RT: La Corte Interamericana de Derechos Humanos dice que Venezuela requiere un "monitoreo especial" en DD.HH. ¿Qué valoración hace al respecto?
A.Z.: En las últimas décadas, la Comisión Interamericana de Derechos Humanos (CIDH) se ha politizado enormemente, ha sido selectiva y no ha supervisado las situaciones en muchos Estados miembros, donde las violaciones de derechos humanos son más graves que las de Venezuela. Especialmente desde que Luis Almagro se convirtió en Secretario General de la OEA, la Comisión ha sido más arbitraria y parece servir a los intereses geopolíticos de los Estados Unidos. En otras palabras, la Comisión aplica arbitrariamente su propio Estatuto, a la carta.
Antes de mi misión a Venezuela, leí todos los informes relevantes de la CIDH. Los considero fundamentalmente defectuosos porque confían principalmente en la información proporcionada por la oposición política a Chávez y Maduro, por parte de ONG internacionales con sus propias agendas. Esencialmente, ignoran la información y documentación proporcionada por ONG locales venezolanas como Fundalatin o la Red Nacional de Derechos Humanos, además, la Comisión no ha dado el debido peso a las respuestas y la documentación proporcionada por el Gobierno de Venezuela.
RT: ¿Cómo evalúa el papel de la ONU en la actual situación de Venezuela?
A.Z.: La ONU violaría su propia Carta si reconociera a Guaidó. El artículo 2 (7) de la Carta, la resolución 2625 de la Asamblea General y otros estatutos lo prohibirían. Además, la ONU y sus agencias ya ayudan significativamente a Venezuela con servicios de asesoría y asistencia técnica.
RT: ¿Cuál es la mejor contribución que la comunidad internacional puede hacer con respecto a Venezuela?
A.Z.: La comunidad internacional debe mostrar solidaridad con el pueblo venezolano y exigir el levantamiento de las sanciones. Debería luchar contra las noticias falsas que han sido desatadas por Washington e insistir en que la Carta de las Naciones Unidas y de la Organización de Estados Americanos (OEA) se cumplan rigurosamente.
RT: ¿Se solucionan los problemas económicos y la crisis política en Venezuela solo si el presidente Maduro deja el poder, como sostiene EE.UU.?
A.Z.: Maduro no renunciará. Tendría que ser asesinado como lo fue (Salvador) Allende, y luego seguiría un retroceso masivo en materia de Derechos Humanos, igual que en 2002 durante el golpe contra Hugo Chávez, cuando Pedro Carmona emitió un decreto que eliminaba 49 piezas de legislación social. Por supuesto, en ese escenario, EE.UU. levantaría las sanciones y comenzaría el gran saqueo de los recursos naturales de Venezuela. Todo se remontaría a los años 80 y 90.

Two days after the tense journey lived in the Colombian-Venezuelan border last February 23, the self-called Group of Lima agreed to promote the appointment by the United Nations Human Rights Council of an independent expert to evaluate what they describe as a “humanitarian crisis” in Venezuela.
The conclave, which brings together nations supporting the USA attempt of ousting the government of President Nicolás Maduro, described as a “crime against humanity” to have prevented the entrance with the use of force of a cargo of “humanitarian help” from Colombia, following orders from the self-proclaimed “president in charge”, Juan Guaidó.
Regarding the theme, Alfred-Maurice de Zayas, Human Rights expert appointed by the United Nations for the promotion of a democratic and equal international order (2012-2018) posted in his Twitter account the signing of a document to enable the High Commissioner on Human Rights Michelle Bachelet to visit Venezuela and verify the true situation in the country. The same petition was made last November by President Nicolás Maduro.

De Zayas, also former secretary of the UN Rights Committee gave his point of view after visiting Venezuela to hold meetings with official authorities, experts and opposition leaders and public and private institutions of the Caribbean country.
Russia Today (RT): Is there a humanitarian crisis in Venezuela?
Alfred-Maurice de Zayas (A.Z.): When I visited Venezuela in November-December, 2017, there was certainly no humanitarian crisis. Any comparison with Gaza, Yemen, Syria, Libya, and Sudan is absurd. But the situation has worsened since then due to the sanctions.
RT: Do you think the USA sanctions are aimed at affecting the government of Nicolás Maduro?
A.Z.: The sanctions are an important element that contributes to the crisis. The malnutrition and lack of medicines may be attributed directly to the sanctions and are geopolitical crimes in the category of crimes against humanity.

RT: The USA warns that Venezuela needs “humanitarian aid”. Has the country the same situation of Libya, Yemen, Mali, Somalia, Sudan and Myanmar?
A.Z.: Venezuela only needs to put an end to the financial blockade and the sanctions. Venezuela has expressed its thankfulness for the international aid to solve the problems created by the sanctions. The USA cannot first strangle the Venezuelan economy and then claim that the country needs humanitarian aid. This is cynical, Machiavellian, bad faith in extreme. You cannot be the torturer and the savior at the same time.
RT: Maduro’s detractors, including the USA, say Venezuela is committing a “crime against humanity” by not allowing the entrance of “humanitarian aid”. What do you think about it?
A.Z.: The government of USA and other countries that impose sanctions are the ones that commit crimes against humanity. Venezuela, of course, accepts any assistance offered in good faith and has already received 933 tons of food and medicines from China, India, and Turkey. A few days ago a cargo aircraft from Russia arrived with tons of medicines and medical equipment. Venezuela accepts the assistance of the UN and other bodies, but not from its main torturer.
RT: The Inter-American Court of Human Rights says that Venezuela requires a “special monitoring” in Human Rights. What is your evaluation in this regard?
A.Z.: In recent decades, the Inter-American Commission of Human Rights has politicized enormously, has been selective and has not supervised the situations in many member States were the violations of human rights are more earnest than those of Venezuela. Especially since Luis Almagro became OAS General Secretary, the Commission has been more arbitrary and seems to serve the geopolitical interests of the United States. In other words, the Commission arbitrarily applies its own Statute, à la carte.
Prior to my mission to Venezuela I read all the relevant reports of the Human Rights Council. I consider them essentially faulty, because they trust mainly the information supplied by the political opposition to Chávez and Maduro of international NGOs with their own agendas. They essentially ignore the information and documentation supplied by local Venezuelan NGOs such as Fundalatin or the National Network of Human Rights; besides, the Commission has not granted the due relevance to the answers and the documentation supplied by the Venezuelan government.
RT: How do you evaluate the role of the UN in Venezuela’s current situation?
A.Z.: The UN would violate its own Charter if it would recognize Guaidó. Article 2(7) of the Charter, Resolution 2625 of the General Assembly and other statutes would forbid it. Besides, the UN and its agencies already grant significant help to Venezuela with advisory and technical assistance.
RT: What is the best contribution the international community could make with regard to Venezuela?
A.Z.: The international community must show solidarity with the Venezuelan people and demand the uplifting of the sanctions. It should fight against the fake news that have been unleashed by Washington and insist on the rigorous observance of the Charter of the United Nations and of the Organization of American States (OAS).
RT: Will the economic problems and the political crisis in Venezuela be solved if President Maduro leaves power, as sustained by the USA?
A.Z.: Maduro will no renounce. He would have to be assassinated, as was (Salvador) Allende, and it would be followed by a massive backward movement in matters of human rights, just as in 2002 during the coup against Hugo Chávez, when Pedro Carmona issued a decree that eliminated 49 pieces of social legislation. Of course, in that scenario the USA would lift the sanctions and the great plundering of Venezuela’s natural resources would begin. Everything would go back to the 1980s and 1990s.
